These Terms and Conditions govern your use of this website and all transactions with Q9 PowerSports USA. Any customer who visits our website or makes a purchase (online or offline) is subject to these terms. Please read them carefully. Use of this website constitutes your agreement to be bound by these Terms and Conditions.

1. Age Requirement

2. Assumption of Risk & Liability Waiver

Important Safety Notice: Riding any powersports vehicle can be dangerous and requires skill and proper safety equipment.

You acknowledge and understand that:

  • Riding ATVs, dirt bikes, scooters, and other powersports vehicles involves inherent risks
  • These activities can result in serious injury or death, and damage to property
  • You voluntarily assume all risks associated with loss, damage, or injury while riding
  • Proper safety gear and training are essential - visit the CPSC ATV Safety Information Center for safety guidelines

Release of Liability: You agree to release and forever discharge Q9 PowerSports USA, its parent company, agents, employees, officers, directors, and the manufacturer from any and all claims, actions, damages, liabilities, costs, expenses, and attorney fees related to your use of vehicles purchased from us, whether or not caused by negligence.

This agreement is binding upon your heirs, agents, personal representatives, and assigns. By purchasing, you waive substantial legal rights to sue or seek damages.

3. Breach of Contract

These Terms and Conditions serve as a final and binding agreement between Q9 PowerSports USA and you, the buyer.

If you breach this contract, you agree to pay all costs associated with:

  • Collection of payment due
  • Removal of harassing, abusive, defamatory, threatening, hateful, or offensive statements about Q9 PowerSports USA, its products, or employees
  • Legal fees, court costs, and associated expenses

4. Credit Card Chargebacks

Important: Once your product has shipped, you waive your right to chargeback your credit card under any circumstance.

All issues must be resolved in accordance with our policies. The chargeback process is expensive and time-consuming. We're committed to working with you to resolve any concerns efficiently. Please contact us first to address any issues.

5. Product Information & Pricing

Q9 PowerSports USA constantly improves our website and strives for accurate product information, including details, pricing, and images.

Please Note:

  • Occasionally, we may receive inaccurate information from manufacturers
  • If you're concerned about product accuracy, contact us before purchasing
  • Prices are subject to change without notice
  • Once your order is placed, there are no refunds or reimbursements if prices change
  • We reserve the right to cancel any order for any reason, including pricing errors
  • Q9 PowerSports USA is not responsible for typographical, technical, or descriptive errors

6. State Laws & Emissions Regulations

7. Manufacturer Warranty

All products and parts sold on our website are covered by a manufacturer warranty facilitated through Q9 PowerSports USA.

Warranty Coverage:

  • One year engine parts warranty (terms vary by manufacturer)
  • Warranty details provided with each vehicle

Warranty is VOID in the following circumstances:

  • Extreme riding, racing, or competition use
  • Vandalism or theft
  • Fire damage
  • Accidents (at fault or not at fault)
  • Unauthorized and/or unlicensed repair or assembly
  • Lack of proper maintenance
  • Modifications to the vehicle

8. New Vehicles

Every vehicle we offer is brand new and in the crate, unless specifically stated otherwise.

Similar to automobiles, vehicles manufactured at the end of the year are considered the next year's new model. This is standard industry practice and allows us to offer the latest models year-round.

9. Shipping & Delivery

We offer free nationwide shipping to the lower 48 states on all powersports vehicles. Learn more about our ordering and shipping process.

10. Returns & Exchanges

Due to the nature of powersports vehicles, returns are handled on a case-by-case basis. Please review our return policy on our FAQ page or contact our customer service team for assistance.
